These Terms of Service ("Terms") are a contract between you and Agentic Commerce OÜ ("Acom," "we," "us," or "our") and govern your access to and use of our website at https://getacom.ai and our software and services (together, the "Service"). By using the Service, you agree to these Terms. If you are using the Service for an organization, you confirm that you have authority to bind that organization, and "you" refers to that organization.
If you do not agree to these Terms, do not use the Service.
1. The Service
Acom helps ecommerce stores become visible and transactable by AI agents. We may add, change, or remove features over time. We may also offer parts of the Service through plans with different limits, which we will describe at sign-up or in an order.
2. Accounts
You must provide accurate information when you create an account and keep it up to date. You are responsible for activity under your account and for keeping your credentials secure. Tell us promptly at hello@getacom.ai if you suspect unauthorized use.
3. Acceptable use
You agree not to:
- Use the Service in violation of any law or third-party rights.
- Upload or transmit malware, or attempt to gain unauthorized access to the Service or its systems.
- Interfere with or disrupt the Service, or probe, scan, or test its security without our written permission.
- Reverse engineer or copy the Service except where the law allows.
- Use the Service to send spam, infringe intellectual property, or process data you do not have the right to process.
- Misrepresent products or use the Service to facilitate fraudulent transactions.
We may suspend or limit access if we reasonably believe you have broken these rules or are creating risk for the Service or other users.
4. Your content and data
You keep all rights to the data and content you submit to the Service ("Customer Data"). You grant us a limited license to host, process, and use Customer Data only to provide and improve the Service and as described in our Privacy Policy. Where we process personal data on your behalf, our Data Processing Agreement applies and is available on request.
You are responsible for the accuracy and legality of Customer Data and for having the rights and consents needed for us to process it.
5. Fees
The Service is currently provided free of charge. We may introduce paid plans in the future. If we do, we will publish the applicable pricing and payment terms and give you reasonable notice before any fees apply to you.
6. Trials and beta features
We may offer trials or features labeled beta, early access, or similar. These are provided "as is," may be changed or withdrawn at any time, and may have additional terms.
7. Intellectual property
We and our licensors own all rights in the Service, including software, design, and trademarks. These Terms do not grant you any rights in the Service except the limited right to use it as described here. Feedback you give us may be used by us without restriction or obligation.
8. Third-party services
The Service may connect to third-party platforms, AI agents, and integrations. We are not responsible for third-party services, and your use of them is governed by their own terms.
9. Term and termination
These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or create legal or security risk. On termination, your right to use the Service ends. We will make Customer Data available for export for a reasonable period as described in our policies or your order, after which we may delete it.
10. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI agents will surface or transact your products in any particular way.
11. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our total liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim or EUR 100.
12. Indemnification
You agree to defend and indemnify us against claims arising from your Customer Data, your use of the Service, or your breach of these Terms, to the extent permitted by law.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new date and, for material changes, give reasonable notice. Continuing to use the Service after changes take effect means you accept them.
14. Governing law and disputes
These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules. The Harju County Court (Harju Maakohus) in Tallinn, Estonia will have exclusive jurisdiction over disputes, unless required otherwise by law.
